The Requisitioning and Acquisition of Immovable Property (Amendment) Bill, 2017, introduced in Lok Sabha by the former urban development minister, M. Venkaiah Naidu on July 18, 2017, after being passed by Parliament, received the presidential assent on August 9, 2018. The Act amends the Requisitioning and Acquisition of Immovable Property Act, 1952.
It amends the regulations governing the compensation to be paid for the acquisition of immovable property by the Centre for purposes related to defence and national security. It seeks to amend a provision to allow the Centre to reissue the notice of acquisition so that the property owner gets an opportunity to be heard. In cases where a notice has been re-issued, for acquirng the property for national security needs, the property owner will also get interest on the compensation payable to him/her. The provision of enhanced compensation is provided only in such cases when the notice of acquisition has been re-issued by the government and the property is being acquired for such purposes as national security and defence.
