In order to select High Court judges, the government is considering a separate order by justices Jasti Chelameswar and Ranjan Gogai, as part of its consultations to revise Memorandum of Procedure (MoP) for selection of high court judges.
The MoP will be finalised in agreement with SC. The order pertains to the conviction of the then Calcutta HC judge CS Karnan for contempt of court by a seven-member bench. The bench convicted justice CS Karnan and underlined the ‘need to revisit the process of selection and appointment of judges’ in their separate order dated July 4. The judgments highlighted two main issues relating to a need to revisit the process of selection and appointment of judges to the constitutional courts.
It also emphasised the need to set up appropriate legal regime to deal with situations concerning the conduct of a judge of a constitutional court requiring corrective measures to be taken other than impeachment.
SC overruled the government’s move to enact National Judicial Appointments commission to replace the present collegium system in 2015.
