The Surrogacy (Regulation) Bill, 2019 was passed in Lok Sabha on 5 August 2019. The Bill aims to ban commercial surrogacy in the country.
The Bill regulates altruistic surrogacy and stops the exploitation of women who are lending their womb for surrogacy
It also provides provisions to protect the rights of children born through surrogacy
The Bill allows only altruistic surrogacy by infertile Indian couples, who are legally married for at least 5 years and within the age group of 23-50 (Female)and 26-55 years (Male) from a close relative.
It prohibits foreigners, Non-resident Indians (NRI) Person of Indian Origins (PIO) from commissioning surrogacy.
Surrogacy cannot be applicable to singles, homosexuals and live-in couples
The Bill will set up National and State Surrogacy Boards for the regulation of the practice and process of surrogacy
